1. Statutory Warranty Rights Apply: Customers benefit from statutory warranty rights.
  2. Inspection and Complaints: Customers must promptly inspect items for completeness and obvious defects upon delivery. Any complaints should be reported to us as soon as possible. Failure to do so does not affect the customer’s legal warranty claims.
  3. Quality of Item: Only our own information and the manufacturer’s product description are considered agreed upon as the quality of the item. Other advertisements, public promotions, and manufacturer’s statements are not considered binding.
  4. Warranty Period: The warranty period is valid for life. Within 30 days of delivery, the customer may obtain a replacement for defective goods free of charge. After the initial 30 days, a handling fee of £5 will be charged.
  5. Acceptance of Delivery: If the customer rejects delivery for reasons other than a major defect severely restricting use or making it impossible, they are considered to have non-accepted the delivery. Delivery may not be refused for insignificant defects.
  6. Exclusions: The warranty does not cover defects due to improper operation, modifications to system components contrary to the contractual basis, use of inadequate organizational means, use in a hardware or software environment not meeting the requirements specified in the license certificate, unusual use, operating conditions, or interventions in the system attributable to customers or third parties.
  7. Remedy of Defects: In the event of a defective delivery, the seller may choose to rectify the defect or provide a replacement delivery without defects. In the latter case, the customer must return the defective merchandise at the request of the seller in accordance with legal provisions.

Grant of Rights in a Contract for the Delivery of Software

Clause 4.8 applies exclusively to contracts for the purchase of software as per Clause 2.2. With full payment of the purchase price, the customer receives a non-exclusive and unlimited right to use the goods as granted in the contract. The goods may only be used by a maximum number of natural persons corresponding to the goods purchased by the customer. Permitted use includes installing the software, loading it into main memory, and using it as intended by the customer. The customer does not have the right to rent or sublicense the purchased goods, publicly reproduce them, make them accessible by cable or wireless, or make them available to third parties for a fee or free of charge. The customer has the right to create a backup copy of the software if necessary to ensure its future use.
